gucci wins dismissal in their legal battle with forever 21

It's not a good hump day for Forever 21. The fast fashion retailer has just lost the latest round in their ongoing court battle with Gucci, after a judge dismissed their complaint against the luxury brand.

The legal dispute has been raging on since June last year, and it's all over some stripes. Forever 21 sought protection against threats of trademark litigation from Gucci over their use of stripe webbing that was similar to Gucci's. Not to be outdone, Gucci responded by filing to dismiss the complaint and file a counter-complaint over trademark infringement, trademark dilution and unfair competition.

In a statement Gucci commented: "Gucci is pleased that its motion to dismiss Forever 21's spurious claims has been granted.

"This is an important step in Gucci's continuing commitment to the protection of its renowned and iconic intellectual property. Gucci looks forward to enforcing its right and prosecuting its trademark infringement, trademark dilution and unfair competition counterclaims against Forever 21."

Forever 21 still has time to dispute the decision and file an amended complaint (by November 17th). If that happens Gucci will have until December 4th to respond. Play nice, guys.
